PURPOSE OF THE C.G.V.

These terms and conditions of sale are intended to define the contractual relations between PARIS PARFUMS and you  the buyer on the conditions applicable to any purchase made through the merchant site of PARIS PARFUMS, that you  be professional or consumer. The acquisition of a perfumed or beauty product through this site implies unreserved acceptance by yourself and these conditions of sale and use. These terms and conditions of sale and use shall prevail over any other general or particular terms and conditions not expressly approved by PARIS PARFUMS, which may change its terms and conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer. Characteristics of goods and services offered The products and services offered are those listed in the catalogue published on the PARIS PARFUMS website These products and services are available within available stocks. Each product is accompanied by a description drawn up by the supplier. PRICES OF PERFUMED PRODUCTS and VAT

Any change in the rate may be reflected in the price of the goods or services. PARIS PARFUMS reserves the right to change its prices at any time, provided that the price in the catalogue on the day of the order will be the only price applicable to the buyer. The prices shown do not include transport and delivery costs provided that they take place in the geographical areas set out below. Geographical area The online sale of the products and services presented on the site is reserved for buyers residing in France, the Dom-Tom or Monaco and for deliveries required in these geographical areas. For the countries of the European Union, the buyer will have the possibility to order online. The usual delivery times will be adjusted and adapted to the area or country delivered and cannot be guaranteed. ORDERS

A buyer who wishes to purchase a product or service must:

confirm its order and payment:Confirmation of the order implies acceptance of these terms of sale and use. -          Cancellation of order

Once the payment is made, the Customer cannot change his order. With or without the creation of a customer account, the Customer always has the possibility to make use of its right of withdrawal, the terms of which are described below.

In this case, the Customer will be informed by e-mail of the cancellation of his order and, if necessary, will be reimbursed by PARIS PARFUMS of the sums he has paid before the cancellation of his order.

-          Withdrawal

The right of withdrawal applies only to natural persons.

(a)       In case of permanent unavailability, and depending on the availability of beauty products or perfumes from our suppliers, PARIS PARFUMS will refund you immediately or within a few days, but before 14 days in the bank account debited at the time of the order, the sums received according to the terms of these General Conditions of Sale.

(b)      In accordance with the Consumer Code, the consumer has 14 calendar days to return, at his own expense, the products not suitable for him. This period shall run from the day of receipt of the consumer's order.

Fragrant or beauty products (flavour, cosmetics, ambiance fragrances,  scented candles) not set by an anti-violation system cannot be exchanged or returned for hygiene reasons. The return package must contain: the product(s) returned, the order number and the date of the order on the order confirmation email. At the same time, the consumer can submit their request by email at the address below.

Attention, however, in accordance with article L121-20-2 (3°), the Consumer cannot return the perfumed product(s) and claim a refund if the product(s) are customized bottles with an engraving made on request, according to the Consumer's specifications.

PARIS PARFUMS undertakes to reimburse the consumer of all sums paid. The refund will be made on the account debited when ordering, upon receipt of the parcel, within a few days and  within a maximum period of 14 days after the consumer exercises the right of withdrawal, subject to compliance with the above conditions.

NON-CONFORMED PRODUCTS

For any non-compliant product, you will need to contact the PARIS PARFUMS Consumer Service, either by email at emmanuelroy@parisparfums.fr  by telephone at +33 (0)3 89 37 07 22 (from 9 a.m. to 12 p.m. to 6.30 p.m., Paris time, Tuesday to Saturday.

The Consumer Service will then tell you what to do. The Products must be returned in their original packaging and packaging with a copy of the invoice. Returns must be made by recommended A. R. PARIS PARFUMS does not accept packages sent in due port. Any risk related to the return of the Product(s) shall be borne by the Consumer.

Upon receipt of the deemed non-compliant product(s), PARIS PARFUMS will carry out as soon as possible a control of the Product(s). If the non-conformity of the Product(s) is confirmed, PARIS PARFUMS will then refund the non-conforming Product(s) to the bank account charged at the time of the order within a very short time but not longer than 14 days after receipt of the non-conforming Product(s)

DELIVERY

PARIS PARFUMS makes every effort to deliver its customers as quickly as possible. Any order placed before 1:30pm will leave and will be shipped the same day through the delivery provider selected by PARIS PARFUMS.

Shipments are made at the address indicated in the order form which can only be within the agreed geographical area. The risk shall be borne by the purchaser from the moment the products have left PARIS PARFUMS' premises. In the event of damage during transport, (clips damaged or torn before opening)  the reasoned protest must be made to the carrier and our services within three days of delivery. Our delivery times are very short. However, these delivery times are only given in a current way; if they exceed a maximum of 30 days from the control and in case of major force,  the sales contract may be terminated and you will be  refund as soon as possible. For deliveries outside France, the customer will be able to get closer to PARIS PARFUMS sellers to know the delivery times and modalities.

DELIVERY DELAYS

The services of La poste Française will be privileged, but any other carrier may be selected by the company PARIS PARFUMS. In case of exceeding the maximum delivery time of thirty (30) days and if the Product(s) ordered have not yet been dispatched, the Consumer may exercise his right to denounce the order, either by e-mail to the address parisparfumsthann@gmail.com  or emmanuelroy@parisparfums.fr  , by telephone at 00 33 3 89 45 38 37 (9h30 - 18h30 Tuesday to Saturday / 14h00 18h30 Monday but also 00 33 3 89 37 07 22 (9h-12h / 14h to 18h30) Paris time, Tuesday to Saturday. As from the exercise of the right of denunciation, PARIS PARFUMS shall make a refund, on the bank account debited at the time of the order, as soon as possible, excluding any other compensation.

 In the event of partial delivery, delivery can be made in several times, and this right will only concern the undelivered balance of the order. Any delay in delivery should be notified as soon as possible by the Consumer, either by e-mail to the address parisparfumsthann@gmail.com  or emmanuelroy@parisparfums.fr  , or by telephone on +33 (0)3 89 37 07 22 (from 9h-12h /14h to 18h30), Paris time, Tuesday to Saturday, so that PARIS PARFUMS can have a survey carried out with the delivery service.

The Consumer should be informed that the duration of a survey is random, as PARIS PARFUMS does not control its implementation. If in the course of this investigation the parcel is found, it will be immediately rerouted to the place of delivery specified in the delivery note. However, if at the end of this investigation the loss of the package containing the Product(s) was confirmed, PARIS PARFUMS will, at its expense, re-ship the Product(s) to the Consumer.

LEGISLATIVE GUARANTEE OF SOLD PRODUCTS

All products supplied by PARIS PARFUMS enjoy the legal guarantee provided for in articles 1641 et seq. of the Civil Code. In the event of non-compliance with a product sold, it may be returned to us. PARFUM PARIS  will take it back, exchange it or repay it. All claims, requests for exchange or reimbursement must be made by post at the following address: PARIS PARFUMS 68 rue de la premier Armée 68800 THANN-France within 30 days of delivery.

You  within two years of the issue of the property to obtain the implementation of the legal guarantee of conformity in the event of a failure to comply. During this period, you must establish that the non-conformity exists and not the date of its appearance.

The legal guarantee of compliance gives you the right to repair or replace the property within 30 days of its request, without charge and without inconvenience to you.

If you ask for repair of the property, but PARIS PARFUMS you  requires replacement, the legal guarantee of compliance is renewed for a period of two years from the date of replacement of the property.

You can  obtain a reduction in the purchase price by retaining the property or terminate the contract by obtaining full refund of the property if:

1° PARFUMS  may not  repair or  replace the perfumed product ;

2° Repair or replacement of the perfumed product takes place after 30 days ;

3° Repairing or replacing the perfumed product causes a major inconvenience for you.

4° The non-compliance of the perfumed product persists despite the attempt to bring our services into conformity, which has remained unsuccessful.

You  are also entitled to a reduction in the price of the good or to the termination of the contract where the lack of conformity is so serious that it justifies the immediate reduction of the price or the termination of the contract. You will not be required to request the repair or replacement of the property in advance.

You are not entitled to the sale resolution if the lack of conformity is minor.

Any period of immobilization of the perfumed product for repair or replacement shall suspend the remaining guarantee until the goods are delivered.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.

LEGAL INFORMATION ON CONSUMER

The consumer shall have two years from the date of issue of the property to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is required to establish only the existence of the non-conformity and not the date of its appearance.

Where the contract for the sale of the property provides for the provision of digital content or digital service on a continuous basis for a period of more than two years, the legal guarantee shall apply to such digital content or digital service throughout the intended supply period. During this period, the consumer is only required to establish the existence of the non-conformity affecting digital content or digital service and not the date of its appearance.

The legal guarantee of conformity entails an obligation on the trader, where appropriate, to provide all necessary updates to maintain the conformity of the good.

The legal guarantee of conformity gives the consumer the right to repair or replace the property within 30 days of his request, without charge and without major inconvenience to him.

If the property is repaired as part of the legal guarantee of conformity, the consumer shall be granted a six-month extension of the initial guarantee.

If the consumer requests reparation of the property but the seller imposes replacement, the legal guarantee of compliance shall be renewed for a period of two years from the date of replacement of the property.

The consumer may obtain a reduction in the purchase price by retaining the property or terminate the contract by obtaining full reimbursement for restitution of the property if:

1° The professional refuses to repair or replace the property ;

2° The repair or replacement of the property shall take place after 30 days ;

3° The repair or replacement of the good causes a major inconvenience to the consumer, in particular when the consumer bears the final costs of taking over or removing the non-compliant good, or if he bears the costs of installing the repaired or replacing good ;

4° The non-conformity of the property persists despite the attempt to bring the seller into conformity, which remains unsuccessful.

The consumer is also entitled to a reduction in the price of the good or to the termination of the contract where the lack of conformity is so serious that it justifies the immediate reduction of the price or the termination of the contract. The consumer is then not required to request the repair or replacement of the good in advance.

The consumer is not entitled to a resolution of the sale if the lack of conformity is minor.

Any period of immobilization of the property for the purpose of repair or replacement shall suspend the remaining security until the condition is issued.

The rights mentioned above result from the application of the ArticlesL. 217-1To L. 217-32 of the Consumer Code.

A seller who obstructs in bad faith the implementation of the legal guarantee of conformity shall be liable to a civil fine of up to EUR 300 000, which may be increased up to 10 % of the average annual turnover (article L. 241-5 of the Consumer Code).

The consumer also benefits from the legal guarantee of hidden defects under thearticles 1641 to 1649 of the civil code, for a period of two years from the discovery of the defect. This guarantee entitles a price reduction if the property is retained or a full refund against restitution of the property.

The seller, in the online selling process, is bound only by an obligation of means; its liability cannot be incurred for damage resulting from the use of the Internet such as data loss, intrusion, virus, service breakdown, or other involuntary problems. -          these General Conditions of Sale and the contractual relations between PARIS PARFUMS and the Customer are governed by French law. Any dispute arising from the application or interpretation of the General Conditions of Sale is, in the absence of an amicable arrangement, within the jurisdiction of the French courts.

-          In accordance with article L.611-1 et seq. of the Consumer Code, you should also be informed of the possibility of recourse, in the event of a dispute, to the procedure for mediation of consumption, the conditions of which are laid down in Title I of Book VI of the Consumer Code.

MAJOR FORCE

None of the parties (Paris Parfums, its partners  and all customers) will have failed to comply with its contractual obligations, to the extent that their performance will be delayed, obstructed or prevented by an accidental event of force majeure. Any act or circumstance that is irresistible, external to the parties, unpredictable, inevitable, independent of the will of the parties and which cannot be prevented by them, despite all reasonable efforts, shall be considered as a case of force majeure.

The Party affected by such circumstances shall notify the other Party within 10 working days of the date on which it becomes aware.

The two parties will then approach, within three months, unless impossibility due to force majeure, to examine the impact of the event and agree on the conditions under which performance of the contract will be continued.

If the case of a major force exceeds one month, these general conditions may be terminated by the injured party.

In addition to those usually used in the case law of French courts and tribunals, the cases of force majeure or fortuitous cases are expressly considered: the blocking of means of transport, earthquakes, fires, storms, floods, lightning, the stopping of telecommunications networks or difficulties specific to telecommunications networks external to customers.

ARCHIVED AND EVIDENCE

PARIS PARFUMS will archive purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the Civil Code. PARIS PARFUMS computerized records will be considered by the parties as evidence of communications, orders, payments and transactions between the parties. Dispute resolution These terms and conditions of online sale are subject to French law.

C.G.V. MODIFICATIONS

We reserve the right to: update these Terms at all times. The information will be given on the first page of our site, at the usual location of our C.GV.. It is your responsibility to read these changes. The changes will apply to the use of the Site after we make this announcement.
